End User License Agreement (EULA)

Licensor

hereafter referred to as Spektralisk, I, or me.

Licensee

The purchaser of the Product, hereafter referred to as you.

Agreement Overview

By purchasing a Product (synth presets, samples, other audio-related materials, or software applications) from Spektralisk, you agree to the terms outlined in this End User License Agreement (EULA). This agreement governs the rights and responsibilities between you (Licensee) and Spektralisk (Licensor). Audio products and software applications are subject to separate provisions within this agreement.

Your Purchase

Your purchase grants you a non-exclusive license to use the Product as outlined in this agreement. You do not own the Product; ownership remains with Spektralisk, protected by applicable copyright laws. All content is my original creation.

Permitted Uses

You may use the samples and/or presets for commercial or non-commercial music and audio productions without seeking additional permission from me.

Prohibited Uses

You may not:

  • Use the Product to create or distribute sound libraries for any synthesizer, virtual instrument, or sample-based product.
  • Redistribute individual samples, presets, sound sets, or audio loops—whether for free or commercially—as standalone files.
  • Repackage or resell the Product, in whole or in part, as audio samples, sound libraries, or sound effects.
  • Sub-license or transfer this license to another party.

Liability Disclaimer

  • The Product is provided as is without warranties of any kind, express or implied.
  • I am not responsible for any direct, indirect, or consequential losses arising from your use of the Product.
  • You are solely responsible for ensuring your use of the Product does not infringe on third-party rights.

Software Applications

This section applies to software applications sold or distributed by Spektralisk, currently: Samplework.

Grant of License

Spektralisk grants you a personal, non-exclusive, non-transferable license to install and use the software on your own computers for personal creative and professional purposes.

Restrictions

You may not:

  • Redistribute, resell, sublicense, or transfer the software or any part of it to any third party.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the software.
  • Remove, alter, or obscure any copyright notices, trademarks, or proprietary markings.
  • Use the software to create a competing product or service.

Beta Software

Software marked as a beta release is provided for early access and feedback purposes. It is provided "as is" without warranty of any kind. Spektralisk does not guarantee that beta software will be error-free, uninterrupted, or suitable for any particular purpose.

Data and Files

The software operates on files and directories that you specify. To the maximum extent permitted by applicable law, Spektralisk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the software, including but not limited to loss of data, loss of files, or damage to your file system. You are solely responsible for maintaining backups of your data.

Intellectual Property

All title, ownership, and intellectual property rights in and to the software remain exclusively with Spektralisk. This agreement does not grant you any rights to trademarks, service marks, or trade names of Spektralisk.

Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with any of its terms. Upon termination, you must destroy all copies of the software in your possession.

License Term

Your license is valid indefinitely unless terminated. Termination may occur if:

  • You violate the terms of this agreement.
  • You return the Product as per the return policy.

If terminated, you must delete all copies of the Product from your devices and cease using it entirely.
